A district court judge recently prohibited Athena Cosmetics, Inc. from marketing or selling its RevitaLash Advanced Eyelash Conditioner in the United States. The ruling came as part of a civil lawsuit brought by Allergan Inc., maker of Latisse, in which the company claimed unfair competition in the marketplace based on the way Athena Cosmetics labeled and marketed RevitaLash Advanced Eyelash Conditioner. Athena Cosmetics will fully comply with the ruling, however the company intends to appeal the ruling to the U.S. Court of Appeals for the Federal Circuit. International marketing and sales are not affected by the ruling.
